Purchasing Policies

Policy Recommendations In the interest of working collaboratively with Hospitals and Health Services, HPV has elected only to use its legislated powers when absolutely necessary.
The development of the HPV/Health Service Operating Model by representatives of the Metropolitan Chief Executives' Forum has significantly altered the manner in which HPV conducts its tender program, from that described in Future Procurement Arrangements in Victoria from a coordinated model to a centralised model.
At the extraordinary meeting of Members on 6 May 2004, the Members determined that the future tender program would be described in terms of a purchasing policy.
General Government Guidelines and Recommendations
HPV has identified certain policies and practices from other branches of Government that offer opportunities such as risk minimisation, and therefore has chosen to recommend that hospitals and health services adopt or develop a set of policies at least the equal of those listed below. Where hospitals or health services are unsure VGPB Policies should always be consulted as a guide.
Purchasing Policies What are Purchasing Policies?
Purchasing Policies are policies ratified by HPV pursuant to Section 134 of the Health Services Act 1988 that provide procurement guidelines for Victorian Public Hospitals.
HPV has the ability to apply, adopt or incorporate any matter contained in any document, code, standard, rule, specification or method formulated, issued, prescribed or published by any person whether
- wholly or partially or as amended by the policy; or
- as formulated, issued, prescribed or published at the time the policy is made or at any time before then; or
- as formulated, issued, prescribed or published from time to time;
To whom does this apply?
A public hospital must comply with each purchasing policy pursuant to Section 134 of the Health Services Act 1988 to the extent that it applies to the public hospital. Formal notice of any Purchasing Policy must be made to all parties so affected, and also through publication via the Government Gazette.
In short, if a purchasing policy has not been issued with the words "pursuant to Section 134 of the Health Services Act 1988" then it is not mandatory.
Internal Policies and Policy Recommendations are provided as a guide and hospitals and health services are not required to comply.
Exemptions
HPV may exempt public hospitals from policies by notice published in the Government Gazette, exempt a public hospital or a class of public hospital from complying with a purchasing policy.
What are the likely purchasing policies to be considered?
HPV is committed to wide consultation and dialogue with hospitals before developing and gazetting policies pursuant to Section 134 of the Health Services Act 1988. Notwithstanding, HPV reserves the right to publish recommendations such as those listed below.

Recommendation: Central Registers of Contracts, Standing Offers and other Agreements - 5.9.2003
 HPV endorses the establishment of central registers of contracts, standing agreements or other offers as a prudent risk management exercise in line with EQuIP Guidelines, and recommends that each hospital or health service maintain a central register of contracts, standing agreements and other offers. more |  |

Recommendation: Code of Conduct for Employees - 5.9.2003
 HPV recommends that hospitals and health services develop a statement on the processes they have adopted to deliver a code of conduct at least the equivalent as those required by the Office of Public Employment and to report their compliance to these rules in their annual report of operations. more |  |

Recommendation: Probity - 5.9.2003
 HPV recommends that hospitals and health services produce a statement on the processes they have adopted to deliver standards of probity and contracting at least the equivalent as those required under VGPB guidelines, and report their compliance to their adopted rules in their annual report of operations. more |  |

Recommendation: Contract Clauses - 5.9.2003
 HPV recommends that hospitals consider inserting Access (Piggyback) and Common Use clauses in their standard contracts, agreements and or standing offers for the procurement of all goods and services.
